GDPR and AI Act in AI marketing, the strict obligations
AI marketing is legally particularly sensitive, you process personal data (existing customers), execute outbound actions (calls, emails), and use AI in customer interactions (AI Act-relevant). Three obligations DACH SMBs must comply with. First, GDPR Art. 6, legal basis for every marketing action. With existing customers usually Art. 6(1)(f) (legitimate interest), with new customers strict Art. 6(1)(a) (explicit consent). Specifically: outbound calls without opt-in are warnable in DACH, Rinqo therefore enforces opt-in tracking per customer and channel. Second, UWG § 7, unreasonable harassment.
